It establishes the rights and duties of owners, how common parts are managed, condominium expenses, and, increasingly in recent years, even the<strong>use of properties for tourist rentals<\/strong>. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-53fb226 elementor-widget elementor-widget-heading\" data-id=\"53fb226\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Amendment of April 3, 2025: what does the new law say?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-04da48a elementor-widget elementor-widget-text-editor\" data-id=\"04da48a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>On April 3, 2025, an important amendment to the LPH, <strong>Article 17.12<\/strong>, which directly affects short-term rentals, went into effect. The law states that: <\/p>\n<ul>\n<li>In order to allocate an apartment for <strong>&#8220;vivienda vacacional&#8221;<\/strong> activity within a <strong>building under horizontal ownership (condominium)<\/strong>, it will be <strong>necessary to obtain the consent of 60 percent of the owners<\/strong>, who also represent 60 percent of the condominium shares.<\/li>\n<li>Without such a permit, the <strong>community may take legal action<\/strong> to stop the activity, with termination proceedings and possible penalties.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-63285b9 elementor-widget elementor-widget-heading\" data-id=\"63285b9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Is the law retroactive?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c2cdd73 elementor-widget elementor-widget-text-editor\" data-id=\"c2cdd73\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>No, the law is NOT retroactive.<\/strong> This means that <strong>the vivienda vacacional licenses already in place will not be affected<\/strong>, as long as they comply with the municipal regulations and regulations in effect at the time of their activation. Those who already have a regular license <strong>will not have to worry<\/strong> unless there are serious violations or legitimate protests from the community. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-63e8df0 elementor-widget elementor-widget-heading\" data-id=\"63e8df0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Residential areas: most affected by the new law<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-80a4f66 elementor-widget elementor-widget-text-editor\" data-id=\"80a4f66\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The April 3 amendment will particularly affect <strong>residential areas<\/strong>, i.e., those <strong>zoned<\/strong> as &#8220;urban residential land&#8221; and not tourist land. This is a key point that many are ignoring-or worse, deliberately misrepresenting. <\/p>\n<p>Areas that will be <strong>most adversely affected<\/strong> by the legislation include:<\/p>\n<ul>\n<li><strong>Las Palmas de Gran Canaria<\/strong>: Triana, Mesa y L\u00f3pez, Siete Palmas and Arenales<\/li>\n<li><strong>Vecindario<\/strong> and <strong>El Doctoral<\/strong><\/li>\n<li><strong>Telde<\/strong>, <strong>Arucas<\/strong> and <strong>Santa Br\u00edgida<\/strong><\/li>\n<\/ul>\n<p><strong>Southern Gran Canaria<\/strong>, on the other hand, is <strong>for the most part classified as tourist land<\/strong>, and therefore <strong>not subject to this law<\/strong>. Areas such as Maspalomas, Playa del Ingl\u00e9s, Meloneras, Campo Internacional, Puerto Rico, Tauro, and Patalavaca are still considered the safest and most profitable for short-term rentals. <\/p>\n<p>However, with <strong>utmost transparency<\/strong>, it is good to specify that <strong>some complexes in the south<\/strong> <strong>have changed from tourist land to residential<\/strong> over the years. This means that even in the south <strong>it is essential to check the zoning classification<\/strong> before buying. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-349e29e elementor-widget elementor-widget-heading\" data-id=\"349e29e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Some healthy controversy: misinformation and psychological terrorism\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-add72c9 elementor-widget elementor-widget-text-editor\" data-id=\"add72c9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Over the past few days I have read numerous posts from <strong>real estate agents and &#8220;professionals&#8221;<\/strong> who paint a doomsday scenario for the short rental market in Gran Canaria. Some claim, without distinction, that &#8220;the law will affect everyone&#8221; and that &#8220;no more renting will be possible.&#8221; <\/p>\n<p>This kind of <strong>psychological terrorism<\/strong> is harmful.
